Terms of Service

Welcome to Vibo Suite. These Terms of Service ("Terms") govern your access to and use of the Vibo Suite platform operated by Nexanum ("we", "us", or "our"), available at www.vibosuite.com and any associated mobile applications (the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Vibo Suite is an AI-powered social media management platform that provides:

  • Vibo Social: Multi-platform content publishing and analytics across TikTok, Instagram, YouTube, LinkedIn, Facebook, and X.
  • Vibo Video: AI-powered video script generation, viral hook suggestions, and content creation tools.
  • Vibo Scheduler: Intelligent content scheduling with AI-optimized posting times.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

2. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately at support@vibosuite.com if you suspect unauthorized access

You must be at least 16 years old to create an account. By using the Service, you represent that you meet this age requirement.

3. Subscriptions & Payments

3.1 Free & Paid Plans

Vibo Suite offers a free tier with limited features and paid subscription plans with additional capabilities. Plan details and pricing are displayed on our website and may change from time to time.

3.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge the payment method on file at the start of each billing cycle. All fees are stated in US Dollars unless otherwise noted.

3.3 Cancellation & Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to paid features until the end of your current billing period. We generally do not provide refunds for partial billing periods, except as required by applicable law.

4. Your Content

4.1 Ownership

You retain all rights to the content you create, upload, or publish through the Service ("Your Content"). We do not claim ownership of Your Content.

4.2 License to Us

By using the Service, you grant us a limited, non-exclusive, worldwide license to store, process, and transmit Your Content solely to provide and improve the Service. This includes transmitting Your Content to third-party social media platforms and AI providers as necessary to deliver the features you use.

4.3 Responsibility

You are solely responsible for Your Content and ensuring it does not violate any applicable laws, third-party rights, or the terms of the social media platforms you publish to.

5. AI-Generated Content

Vibo Suite uses artificial intelligence to generate content suggestions, video scripts, hooks, and other creative outputs ("AI Content"). You should be aware that:

  • AI Content is generated by machine learning models and may not always be accurate, original, or appropriate.
  • You are responsible for reviewing, editing, and approving all AI Content before publishing it.
  • We do not guarantee that AI Content will be free from errors, bias, or intellectual property issues.
  • Content you submit for AI processing may be sent to third-party AI providers (OpenAI, Replicate) under their data processing agreements.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Distribute spam, malware, or harmful content
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Automate access to the Service beyond what is provided through our official interfaces
  • Impersonate another person or misrepresent your affiliation
  • Use the Service to generate or distribute content that is illegal, hateful, harassing, defamatory, or obscene

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

7. Third-Party Platforms

The Service integrates with third-party social media platforms. Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for the actions, content, or policies of any third-party platform.

We do not guarantee uninterrupted access to third-party platform APIs. Changes by third-party platforms may affect the availability of certain features.

8. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by Nexanum and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or secure.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Nexanum, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms.

11. Termination

You may terminate your account at any time by deleting it from your profile settings or by contacting us. We may also terminate or suspend your account if you violate these Terms or for any other reason with reasonable notice.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

12. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Germany.

If you are a consumer in the European Union, you retain all mandatory consumer protection rights granted by the laws of your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.
